A MAN who allegedly tried to rob a victim as he withdrew money from a Pinjarra Road ATM was granted bail in court on Friday despite police opposition.
Brayn Nyoni, who is currently in Australia on a protection visa, appeared in Mandurah Magistrates Court on Friday in custody and did not enter speak other than to confirm his name.
The 28-year-old, who police argued had no fixed address and prior breaches of bail during his six years in Australia, was said to pose no flight risk despite his lawyer conceding Mr Nyoni had no family in the country.
It will be alleged Mr Nyoni approached a man withdrawing $300 from an ATM from behind on Thursday and told him “I’m taking that money” before wrestling the victim to the ground as he clung on to the cash he had just withdrawn.
The court heard the victim has not seriously injured in the attempted robbery.
Police prosecution told the court Mr Nyoni made admissions in a police record of interview to being near the ATM and to assaulting the victim.
Despite police opposition to bail, an application was made by counsel for Mr Nyoni who spent one night in custody following his arrest.
It was argued the accused could live in Falcon with a friend and was currently in the process of applying to become an Australian citizen.
Magistrate Vivien Edwards granted Mr Nyoni a $5000 personal undertaking bail with a $5000 surety.
He was ordered to reside in Falcon and report to the Mandurah Police Station three times a week.
Mr Nyoni will next appear in court on September 19.
