The Mandurah Mail, 97.3 Coast FM and Simply Home Cinema Terms & Conditions – Pinjarra Park Race Day

April and May 2009

1. By participating, entrants agree to be bound by all these Terms and Conditions. Instructions on how to enter and other details contained within promotional advertisements for this competition form part of these Terms and Conditions. The promoter’s decision will be final and no correspondence will be entered into. The promoter reserves the right to amend rules if considered necessary, without notice.

2. The promoters are Mandurah Mail, West Coast Radio Pty Ltd and Simply Home Cinema. Entry is open only to residents of Western Australia except employees of West Coast Radio Pty Ltd The Mandurah Mail and Simply Home Cinema (or their subsidiaries), agents, or members of the immediate families of such employees. Immediate family shall be deemed to include mother, father, son, daughter, brother, sister, husband, wife or defacto husband and wife.

3. The competition runs from 19 April 2009 and concludes 6 May 2009.

4. The format of the competition provides a 30 and/or 15 second promotional

spot/s broadcast on 97.3 Coast FM encouraging listeners to enter the promotions over the above specified period.

5. Correct entry details must include name, address, age and daytime phone number.

6. The major prize is as follows:

 Sharp 32inch LCD TV and installation free of charge valued at over $2000 supplied by Simply Home Cinema on Magenta Terrace

7. The prize-winners will be in person and therefore MUST be in attendance to collect their prize.

There will be no cash alternative. The prize is non-transferable.

8. On the date of 6 May 2009 one name will be randomly drawn from all qualifiers who have entered by filling out the entry form in the Mandurah Mail and putting it in the barrel provided at the entrance of the race course. The winner drawn from the barrel must have the correct Coast Code Word written on their entry.

9. Entry to the competition is by way of listening to 97.3 Coast FM for the code word of the day and filling in the entry form in the Mandurah Mail. The promoter reserves the right to amend rules if considered necessary without notice.

10. Listeners can win one prize only in a given 60 day period, meaning if they have qualified to win a prize, then they cannot have won a prize within 60 days prior and therefore would not be eligible to win a prize within the next 60 days following. The station reserves the right to disqualify listeners found to be in contravention of the preceding rule.

11. If any one of the winners of the holidays is under the age of 18 years, the prize will be transferred into the name of an adult or guardian nominated by the winner. Both the winner and the nominated adult or guardian will be required to establish both their identities to the satisfaction of the station.

12. All prizes are STRICTLY non-transferable.

13. All prizes must be collected on the day at the event. A voucher will be presented to the major prize winner to take to Simply Home Cinema and arrange the prize with management. All other voucher prizes will be handed out on the day.

15. All entries become the property of the promoters. Entries not completed in accordance with the rules and conditions or received after the closing date

will not be considered. Indecipherable or incomplete entries will be disregarded. The judge’s decision in relation to any aspect of the competition is final and binding on every person who enters.

16. Entrants must agree to make themselves available for publicity purposes at any time without charge.

17. The promoters and associated agencies will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with the prizes except for any liability which cannot be excluded by law.

18. If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the competition. The promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries. The promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by the promoter on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this competition.

19. Mandurah Mail, West Coast Radio Pty Ltd and Simply Home Cinema accepts no responsibility for accident, loss, injury or damage to any individual or property arising out of in conjunction with the competition either during or after the competition.
